Upon deposit payment, you agree to these terms and conditions
A non-refundable deposit is required to reserve my services. If the shoot is cancelled or postponed by the client or via Force Majure (natural disasters like hurricanes, floods, earthquakes, and weather disturbances, Also includes war, terrorism or threats of terrorism, civil disorder, labor strikes or disruptions, fire, disease or medical epidemics or outbreaks, and curtailment of transportation facilities preventing or delaying attendance by at least twenty-five percent of meeting participants. Also to include “acts of God”), the non-refundable retainer payment will not be returned, it being the agreed loss suffered by the photographer due to cancellation. The remaining balance of your package is due directly after your photo session (unless previously agreed upon).
NO photo taking or video taping is allowed during session by anyone other than the photographers.
If PCBeach Memories is unable to perform to this contract due to any cause beyond the control of the parties, PCBeach Memories shall have no further liability with respect to this agreement.
If PCBeach Memories is unable to perform the obligations in this contract in the event of photographer’s illness or for any other reason, PCBeach Memories will not be liable for costs in excess of the amount the client has paid. This limitation of liability will also apply in the event that the high resolution digital files are lost through camera malfunction, damaged in processing, lost in the mail, or otherwise damaged or lost with or without fault of the photographer. While every attempt is made to create the best images possible, no particular photo is guaranteed.
The client will obtain all rights to proofs and all high resolution digital files which may be used for personal use only, and may not be sold or published without the written consent of PCBeach Memories .
Once the files are delivered to the client, it is the client’s sole responsibility to protect and retain their images for the future. It is highly recommended that digital media and USB’s be duplicated and stored in multiple locations.
All rights to any media created by PCBeach Memories will remain with the photographer
. PCBeach Memories reserves the right to display any photographs made in conjunction with this photo session as samples of their work for the purposes of window and showroom exhibit, advertising, promotion on the internet, publication, instruction and professional competition.
The clients understand that if during the photo shoot the client arrives late and the sun has set, high ISO settings (film’s sensitivity to light) must be used; creating a pixelated or grainy effect in the photographs.

The client agrees that the work delivered will be of a similar style and caliber to those photographs on PCBeach Memories website and blog, and that the photographer will have complete creative control during the photographs and in post-processing. The images will be delivered in JPEG format with a mix of color and black and white images, and deemed appropriate by the photographer. No re-editing will be done after the final edited copies are presented to the client. The client agrees that the photographer can only capture the photo shoot as it happens: weather, location, schedule complications, time restraints and subject’s ability to cooperate, are all factors in the quality of the photographs. The photographer will not edit for physical size, hair, nor any other physical appearance issue other than blemishes. This clause applies to social media including, but not limited to Facebook, Instagram, and blogs. When published online it is required that citation of photographer be made. The client agrees that they will under no circumstances alter the photographer’s media that is placed in public or on the internet. As a photographer, the media needs to be an accurate representation of PCBeach Memories work so that future clients have a good understanding of their brand and style. The client agrees to be responsible for any family member or friend who posts photographs online and agrees that they cannot be cropped (with the exception of forced cropping on social media), altered in color, or edited in any way. Through reading these terms and conditions the client understands that if the client is unable to make the date and time of the scheduled session, the deposit is non- refundable, and their session will be rescheduled, but with no commitment that their session will be able to be rescheduled. If the client is more than five minutes late for a session, the time for that session will begin without delay due to other sessions being scheduled throughout the day. After 10 minutes of being late, the session will be considered cancelled without refund. By paying for the deposit, you are agreeing to the above and understand your responsibility as a client for PCBeach Memoriesragraph.
